Acted for Star Recruitment Service Pty Ltd, a licensed labour hire provider, in a $1.63M insolvent trading claim against the sole director of GG Group (QLD) Pty Ltd over unpaid strawberry-picking labour hire invoices. The Court delivered an important judgment for directors and insolvency practitioners on the construction of the COVID-19 temporary safe harbour in s 588GAAA of the Corporations Act, and on causation and set-off arguments premised on alleged defects in supplier performance.
[2024] QSC 120 (Supreme Court of Queensland)
Acted for Semper Mortgage Management in successfully defending an unfair contract terms challenge to its standard form private lending documents under the ASIC Act regime. The decision is regarded as a landmark for the private credit and non-bank lending industry, confirming that commercially negotiated risk-allocation, default interest and enforcement clauses can be reasonably necessary to protect a private lender's legitimate interests. Jin's role and reflections on the case are featured in Lawyers Weekly.
